Terms and Conditions

 

  1. By accepting a quote, you agree to and accept the terms and conditions of Sixtyone Design Pty Ltd. Acceptance can be verbal, by email, payment of initiation, signing a quote.
  2. Set packages on offer are : Basic responsive and eCommerce websites $650 + GST (Theme developer licence, CMS, Design, Responsive, SEO BASIC, and Stripe payment system). These prices are based on the templates provided to choose from only. Please note Hosting and Domain registration is additional, paid directly to third party supplier.
  3. The offered websites sites are limited to specific eCommerce compatible templates. Not all templates are suitable for an eCommerce website. All product information including, but not limited to, names, descriptions, images/photos, prices, package sizing/dimensions, are to be provided to Sixtyone Design Pty Ltd in a Comma Separated Variable (CSV) file format, supplied to you by us. All information supplied to us by you are to be correct and true with regards, but not limited, to product information and pricing. Any changes to products information or images after products have been imported into the website, may incur additional charges. Supported eCommerce payment gateways is Stripe only. No other payment gateways will be offered at this time. Shipping will be the responsibility of the client to arrange based on the current COVID 19 evolving situation.
  4. Template layouts and functionality will have no changes to them apart from the template’s colour, logo, content, and images. Price allows one (1) round of minor changes. Any changes after the one (1) round of changes will be charged accordingly. With ecommerce templates, 10 product uploads are included, ant additional will be billed at $5.00 + GST each.
  5. Any additional functionality or changes to the template requested by the client will be quoted for approval prior to acceptance.
  6. Payment can be made by online, Direct Deposit, Visa or Mastercard. Please note any Eftpos payments incur a 0.25% transaction fee of the total.
  7. There are no discounts on offer as the price has already been reduced to assist companies.
  8. Clients to ensure that Sixtyone Design Pty Ltd have included all requirements in the quotes/proposals/estimates and that we fully understand their requirements. Clients must provide us with clear guidelines along with the flow or specific details they may require. We operate in good faith and rely on our clients to disclose the full picture at the time of quotation. Any discrepancy arising due to unclear requirements will not be borne by Sixtyone Design Pty Ltd. When such details are not provided, we will proceed with our understanding of the requirements. At a later stage, if a discrepancy arises, it may lead to additional costs to accommodate the changes. Thus, it is essential that you clarify every aspect of your website development and ensure that you have been quoted on the right requirements.
  9. The website build time will begin once Sixtine Design Pty Ltd have received all website content and all related materials that is required to start the project. When all content has been received the client will be advised by Sixtyone Design Pty Ltd of the starting date of their website build.
  10. At any stage during the project, delaying of the project by the client for over one (1) calendar month will incur $90 + GST per week administration cost. Furthermore, it may increase the previously approved estimates.
  11. If you require the project to be put on hold, please advise us in writing in advance. To put the project on hold without incurring additional charges, Sixtyone Design Pty Ltd will require your account to be paid in full.
  12. If a debt collecting agency is engaged to cover costs owing to Sixtyone Design Pty Ltd, all associated costs from the recovery agency will be passed onto the client.
  13. Sixtyone Design Pty Ltd will make every effort to complete the project/changes in the given timeframe. Reasonable delays are accepted by the client if functionalities are redefined or modified.
  14. Any bugs (programming errors) reported during or just after the live deployment of the website does not attract additional charges.
  15. Any re-work on an already completed task will attract additional charges. Any changes in the design after the design approval will incur additional charges.
  16. Any modifications requested during the development or after the Go-Live approval will incur additional charges. All additional work, over and above the estimates is charged separately.
  17. Under no circumstances will Sixtyone Design Pty Ltd be liable for any delays caused by change in the project brief.
  18. Responsive/multi-device compatible web pages are tested on current iPhone, iPads, Android devices as well as tested on modern desktop web browsers.
  19. The website will require a web hosting account for it to be loaded on to. Hosting details are to be provided by the client. Sixtyone Design Pty Ltd can organise an appropriate hosting solution if required. Sixtyone Design Pty Ltd have no responsibility or liability of issues arising with your hosting account. The client is responsible for the initial and ongoing payment of their web hosting account. Sixtyone Design Pty Ltd will require the logins to access the web hosting account during the website build.
  20. The client is responsible for the purchase, registration, and ongoing cost of the domain name(s). Sixtyone Design Pty Ltd will need access to the domain name account during the building of the website.
  21. Depending upon the functionalities required, there may be 3rd party components such as Third Party Payment Gateways or SSL certificates involved in building a website/application. Although Sixtyone Design Pty Ltd does it’s best in recognising the suitability of any such component, any unforeseen limitations of 3rd party components are beyond our control. Any third-party component purchase costs (such as SSL, Payment gateway, Google Adwords, Plug-in licenses etc) are not included in our quotes.
  22. Sixtyone Design Pty Ltd takes no responsibility of any open source products such as WordPress, Open Source carts, Joomla etc. It is clients responsibility to update all components and third party softwares.
  23. Sixtyone Design Pty Ltd takes no responsibility in maintaining of website backups once the website has gone live. It is the responsibility of the client to ensure that adequate backups of the website are made and stored in a suitable manner.
  24. The client must recognise that at times there may be unforeseen circumstances that will delay the development process, particularly with reference to the integration of third party software. We will try our best to complete the project as agreed in the proposal. As long as it is within a reasonable period, the client agrees not to penalise us for any genuine delay, when every effort to keep the project on the proposed schedule is taken.
  25. Sixtyone Design Pty Ltd generally builds and tests the websites/applications on our own servers or hosted domains. Sixtyone Design Pty Ltd cannot give access to their test servers and test websites to the clients or any third party. The website/application can be transferred-off to a nominated 3rd party server upon full payment of all invoices and dues.
  26. All communications/correspondences are generally done via emails. It is client’s responsibility to keep us updated with their relevant email addresses.
  27. Sixtyone Design Pty Ltd reserves the right to change the above terms and conditions at any time without notification.
